1. Definitions
1.1. Agreement – this user agreement.
1.2. Seller – Rychagov Anton Vladimirovich, bank details are specified in the section 9.
1.3. Website – an oniclay.com website, subdomains, software provided on the website.
1.4. Client – a person who uses the Website.
1.5. Product – a product that the Seller has placed on the Website.
1.6. Waiting List – a database of Clients who want to purchase a Product in the future.
2. Scope of the Agreement
2.1. The Seller offers the Client to leave a request and sign up for the Product Waiting List, wait for their turn to purchase the Product, and then buy the Product on the terms specified in the Agreement, and the Customer accepts the terms of the Agreement in its entirety and without exceptions.
3. Procedure for Execution of the Agreement
3.1. The Client fills in the fields (name, email address, country of delivery, and city of delivery) in the "Waiting List" section on the Website and clicks the "Submit" button, thereby accepting the terms of the Agreement in its entirety and without exceptions.
3.2. The Client's data is included on the Waiting List.
3.3. As the Product is ready to dispatch and as the Clients's waiting in the Waiting List is over, the Seller will specify whether delivery of the Product to the Customer's country and city is possible.
3.3.1. If the delivery is not possible, the Seller notifies the Client by email and excludes the Client from the Waiting List.
3.3.2. If the delivery is possible, the Seller:
3.3.2.1. notifies the Client about this by email, and specifies additional information about the Client in correspondence with the Client by email.
3.3.2.2. defines and specifies the cost of the Product to the Client.
3.3.2.3. defines and specifies the cost of delivery of the Product to the Client.
3.3.2.4. sends the customer payment details for the Product.
3.4. If the Client paid for the Product and shipping cost, the Seller negotiates with the Client about the expected date of readiness of the Product and the dispatch period.
3.4.1. If the Client cannot pay for the Product, the Seller transfers the Client to a new Waiting List.
3.4.2. If the Client does not respond to the Seller's email within 3 (three) calendar days, the Seller excludes the Client from the Waiting List.
3.5. After the terms are agreed, the Seller sends the Product to the Client and sends via email the tracking number for tracking the parcel with the Product.
3.6. The Client monitors and controls the delivery of the parcel with the Product and receives the Product at the delivery address.
4. Delivery of the Product and Terms of Delivery
4.1. The delivery period of the Product is 1 (one) month from the date of dispatching the parcel with the Product. Terms depend on the delivery service and destination country. Delivery of the Product is carried out by the courier service EMS – "Russian Post".
4.2. If during the delivery process the Client notices that the delivery time has exceeded 1 (one) month and the Product has not yet been delivered, the Client is obliged to inform the Seller by e-mail.
4.3. After receiving an email from the Client, the Seller issues a request to locate the parcel with the Product.
4.4. The search for a parcel with the Product takes place within a period of 3 (three) to 4 (four) months.
4.5. If the delivery service has recognized the parcel with the Product as lost as a result of the search, the Client has the right to:
4.5.1. refund the cost of the Product and its delivery. The Seller returns the paid amount to the Client in the same way as it was paid.
4.5.2. order the Product again. In this case, the Customer does not pay for the cost of the Product and its delivery.
5. The price of the Product and payment procedure
5.1. The price of the Product is indicated by the Seller on the Website in roubles of the Russian Federation and US Dollars, depending on the Client's country of residence. The price of the Product on the Website can be changed by the Seller unilaterally. However, the price of the ordered Product cannot be changed.
5.2. If the Product price is specified incorrectly on the Website, the Seller informs the Client about it by email to confirm the corrected price or to cancel the Order. If it is impossible to contact the Client, the order is considered cancelled.
6. Responsibility of the Parties
6.1. If upon receipt of the Product the Client finds that the Product has flaws or the Product is damaged, the Client:
6.1.1. takes photos of the Product so that the flaws or damage can be seen.
6.1.2. sends photos to the Seller's email address.
6.1.3. The Seller reviews the photos within 5 (five) working days.
6.1.4. If the Seller has identified any defects in the Product the Client has the right to:
6.1.4.1. refund the money paid for the Product. The Seller returns the paid amount to the Client in the same way as it was paid.
6.1.4.2. order the Product again. In this case, the Customer does not pay for the cost of the Product and its delivery.
6.1.5. Depending on the Client's choice, the Seller returns the money or sends the same Product to the Customer.
6.2. Damage to the package in which the Product is packed is not considered a flaw of the Product.
7. Confidentiality and Personal Data Protection
7.1. The Seller processes the Client's personal data in accordance with the applicable law and the Privacy Policy. The Privacy Policy is located in the footer of the Website, at the address:

7.2. By accepting this Agreement the Client agrees to the processing of personal data for the following purposes: adding a Client to the Waiting List; the delivery of the Products to Clients, promotion of Products, works and services of the Seller by direct contact with the Client by e-mail, transfer Client's personal data to a third party – JSC "Russian Post", including courier service, Russian Post "EMS" (TIN:
7724490000) for delivery of parcels with the Product.
7.3. The Seller does not disclose the Client's personal data and respects their confidentiality in accordance with the applicable law.
8. Legal Communication and Notifications under the Agreement
8.1. Any messages, suggestions, claims, reports, other legally significant correspondence, messages and notifications are sent by email.
8.2. Such messages are considered appropriate if they are sent to the email address specified in the Agreement section 9. When conducting electronic correspondence, the parties guarantee the safety of passwords.
